our agreement with you
Terms of
Engagement.
These terms apply to every job we do for you: websites, ecommerce, SEO and AI search, hosting and care plans, and custom software. Your written quote sets the work and the price. These terms set how we work together.
Version 1 · effective 19 October 2026 · see also our website terms and privacy page
1 · who and what
The parties and the documents
- Us. Alien Web Design is part of Alien IT Solutions, a sole trader based in Sydney, Australia. ABN 32 385 519 280. Phone 02 9161 8000.
- You. The person or business named on the quote or on our welcome form.
- The agreement. Your written quote, these terms, and our website terms. If they disagree, the quote wins, then these terms, then the website terms.
- Acceptance. You accept these terms when you tick the box on our welcome page, accept your quote, or pay the deposit. If you accept for a business, you confirm that you can agree for that business.
2 · scope and price
The number is agreed before work starts
- Your quote sets out the work, the price and what is included. We do the work in the quote.
- Prices exclude GST unless the quote says otherwise. We add GST to each invoice.
- We do not bill by the hour. The final invoice is not bigger than the number agreed.
- If you ask for work that is not in the quote, we price the change and agree it with you in writing before we build it.
- Your quote states how many rounds of revisions it includes. An extra round is a change, and we price it before we start it.
3 · payments
Website and software builds are paid in three parts
- Invoices are due within 14 days of the invoice date, unless the invoice states a different date.
- We put the site live after the final payment clears.
- Monthly services, such as care plans and SEO plans, are invoiced each month. Those invoices are also due within 14 days.
- If an invoice is overdue, we can pause work on your job until it is paid. We tell you before we pause.
- Costs from other companies, such as domain registration, paid plugins, licences and advertising spend, are not in our price unless your quote includes them.
4 · your part of the job
We need the material and decisions from you
- You supply the content, photos, logins and decisions that the job needs.
- You must hold the rights to any text, images, video, branding, data or other material you give us.
- You check the work when we ask, and you tell us clearly what to change.
- Do not send passwords by email or in a form. We set up access with you, for example by adding us as a user on your accounts.
5 · ownership
It is your site
- Code. You own the code we build for you when the job is paid in full.
- Domain. You own your domain.
- Hosting. You are not locked in. You can move the site to another host at any time.
- Our tools. Tools, templates and code that we had before your job, or that we use for many clients, stay ours. You get a permanent licence to use them as part of your site.
- Our portfolio. We can show the finished work in our portfolio. Tell us in writing if you do not want this.
6 · hosting and ongoing plans
After launch
- Build packages include hosting, SSL and monitoring for the first year.
- After the first year, you can renew hosting at the price on our packages page, change to a care plan, or host somewhere else.
- SEO plans and care plans have no lock-in contract. To stop a plan, tell us in writing. The plan stops at the end of the month you have already been invoiced for.
7 · cancellation
If you cancel a build
- You can cancel a job at any time. Tell us in writing.
- After we start work, the deposit is not refundable.
- If the work we have done is worth more than the deposit, we invoice the extra work. We calculate it from the quoted price and the work completed.
- When those invoices are paid, we give you the work completed to that point.
8 · search, ai and other platforms
What we cannot control
- We do not guarantee search rankings or AI and chatbot citations. Google decides its rankings. Nobody controls whether an AI assistant names a business.
- Google, Cloudflare, WordPress, payment providers, registrars and other third-party platforms can change without notice. Those changes are outside our control.
9 · confidentiality
Your information stays with us
We keep your business information, logins and data confidential. We use them only to do your job. Our privacy page explains how we handle personal information.
10 · rights and responsibility
Australian Consumer Law still applies
Nothing in these terms limits any rights or consumer guarantees you have under the Australian Consumer Law. Where the law allows responsibility to be limited, our responsibility for a job is limited to re-doing the work or refunding what you paid for it. To the extent the law permits, we exclude indirect or consequential loss such as lost profits. These terms are governed by the law of New South Wales, Australia.
11 · changes to these terms
The version you accepted applies to your job
If we change these terms, we publish a new version at a new address. A new version applies only to work you accept after it is published. This page stays online as Version 1.
